Justice system reform is being implemented in Japan. The number of attorneys ( bengoshi ) has substantially increased and concerns have been raised about the impact on the profession's quality and ethics. The profession has called for a slowdown in the increase. Does the increase really adversely affect legal ethics in Japan? Should the pace of the reform be slowed down, from the perspective of maintaining legal ethics? This paper begins to answer these questions through empirical analysis of (1) whether (...) there is an increase in cases of ethical concerns; and (2) whether such an increase (if any) is caused by the increase in bengoshi . The paper then investigates whether there is an over-supply of bengoshi . It concludes with a discussion of the negative impact that a slowdown of the increase may have on access to justice and the bengoshi profession's (ethical) responsibilities. (shrink)

Projects that challenge students to practice service leadership for civic improvement can address the aim of developing civic-mindedness in undergraduates. We conducted two qualitative studies. First, we investigated the learning experiences of four teams of undergraduate business students, who undertook semester-long course-embedded service-learning projects in partnership with four Hong Kong-based social enterprises. The students described five modes of civic engagement as project purposes, mentioned applying six types of service leadership practice for civic improvement, and described eight types of developmental outcome (...) within the domain of civic-mindedness. Comparisons suggested that besides relational support through training and guidance, empowering infrastructure, opportunities to exercise autonomy, and opportunities to demonstrate competence, three project-related features that varied between projects were important in fostering civic-mindedness. These were direct contact with grassroots-based beneficiaries; the experience of making a tangible difference; and linking the campus with the wider community. A second qualitative study indicated that course-embedded team projects with these features that were undertaken in mixed teams that included freshman and senior year business students fostered civic-mindedness for both categories of student. Environmental eco-centrism, the claim that all members of the biosphere are ontologically and axiologically equal, presents a challenge to traditional ethical conceptions of the special status of humanity. Confucian and Kantian ethics approach this topic, and its application to other animals, in different ways: Confucianism employs stories that promote insight into the importance of sincerity and compassion to all animals, including non-human ones; Kant employs abstract reasoning to argue that non-human animals deserve respect because we humans share their basic nature. A large body of research links testosterone and cortisol to male-male competition. Yet, little work has explored acute steroid hormone responses to coalitional, physical competition during middle childhood. Here, we investigate testosterone, dehydroepiandrosterone, androstenedione, and cortisol release among ethnically Chinese boys in Hong Kong, aged 8–11 years, during a soccer match and an intrasquad soccer scrimmage, with 63 participants competing in both treatments. The soccer match and intrasquad soccer scrimmage represented out-group and in-group treatments, respectively. Results revealed that testosterone showed (...) no measurable change. DHEA increased during both treatments in the majority of participants and the degree of change had no relation to independent variables or covariate measures. Most boys experienced androstenedione increases during match play, but no significant differences during the intrasquad soccer scrimmage competitions. The magnitude of change differed significantly between treatments and was positively associated with age. These latter findings suggest boys’ androstenedione responses may be sensitive to competitor type. For most subjects, cortisol significantly increased during match play, decreased during the intrasquad soccer scrimmage, and differed significantly between treatments, suggesting each treatment promoted a different psychological state among competitors. Cortisol/DHEA molar ratio decreased during the intrasquad scrimmage, suggestive of a more relaxed mental state. These data shed new light on potential proximate mechanisms associated with coalitional competition among prepubescent boys, with relevance to adrenarche and life history theory. (shrink)

This study examines the relationship between procedural justice and employee job insecurity, and the boundary conditions of this relationship. Drawing upon uncertainty management theory and ethical leadership research, we hypothesized that procedural justice is negatively related to job insecurity, and that this relationship is moderated by ethical leadership. We further predicted that the moderating relationship would be more pronounced among employees with a low power distance orientation. We tested our hypotheses using a sample of 381 workers in Macau and Southern (...) China. The results support all of our hypotheses. Could Christians and Muslims be referring to the same God? For an account of the reference of divine names, I follow Bogardus and Urban (2017) in advocating in favour of using Gareth Evans’s causal theory of reference, on which a name refers to the dominant source of information in the name’s “dossier”. However, I argue further that information about experiences, in which God is simply the object of acquaintance, can dominate the dossier. Thus, this demonstrative use of names offers a (...) promising alternative avenue by which users of the divine names can refer to the same referent despite having different conceptions of God. Essa pesquisa esclarece, de forma concreta, duas linhas de pensamento, que são a epistemológica, por um lado, e a ética, por outro, enfocando os parágrafos nos quais Deleuze e Guattari usam efetivamente esse conceito. Do ponto de vista epistemológico, o conceito de platô permite praticar uma maneira de escrita rizomática e a explicação antiteleológica. Do ponto de vista ético, esse conceito, tirado (...) de Gregory Bateson, nos convida a formar a alegria contínua e global, ou a gaieté em termos espinosistas. In this paper, we question the workings of the concept of plateau in "A Thousand Plateaus" (1980), Deleuze and Guattari's chef-d'oeuvre. This research specifically clarifies two lines of thought, which are epistemological on the one hand, and ethics on the other hand, focusing on the paragraphs where Deleuze and Guattari actually employ this concept. From the epistemological point of view, the concept of plateau allows practicing a way of rhizomatic writing and anti-teleological explanation. From the point of view of ethics, this concept borrowed from Gregory Bateson invites us to form the continuous and global joy, or gaiety in Spinoza's terms. (shrink)

The double nature of Mencius' notion of human dignity as an intrinsic quality of human beings qua being human is analyzed and contrasted with the dominant Western account of human dignity as grounded in personhood. This paper aims to provide a rendition of the care ethic in Confucian philosophy and to argue that social policy developments in Hong Kong society, including health care policy, have been significantly shaped and justified in terms of the ideal of care in the Confucian moral tradition. On the basis of this analysis, the paper raises a number of questions about a recent proposal for health care reform for Hong Kong put forth by the Harvard School of Public Health which (...) argues for adopting the principle of equity as the overriding value for the moral foundation of Hong Kong's health care system. The paper examines how the over-emphasis on equity in the Harvard Report proposals can lead to the erosion of care and ultimately the eclipse of the vision of care in Hong Kong's health care system. It argues that the pursuit of equity, which is itself a valuable principle, should not displace the importance of the value of care or undermine the ideal of care and that health care decisions must be firmly embedded in local cultures and moral traditions. The Czech philosopher Jan Patocka (1907-1977), who studied with Husserl and Heidegger, is widely recognized as the most influential thinker to come from postwar Eastern Europe. Refusing to join the Communist party after World War II, he was banned from academia and publication for the rest of his life, except for a brief time following the liberalizations of the Prague spring of 1968. Joining Vaclav Havel and Jiri Hajek as a spokesman for the Chart 77 human-rights declaration of 1977, Patocka (...) was harassed by authorities, arrested, and finally died of a heart attack during prolonged interrogation. Plato and Europe, arguably Patocka’s most important book, consists of a series of lectures delivered in the homes of friends after his last banishment from the academy just three years before his death. Here, he presents his most mature ideas about the history of Western philosophy, arguing that the idea of the care of the soul is fundamental to the philosophical tradition beginning with the Greeks. Explaining how the care of the soul is elaborated as the problem of how human beings may make their world one of truth and justice, Patocka develops this thesis through a treatment of Plato, Democritus, and Aristotle, showing how considerations about the soul are of central importance in their writings. The prospect of using genome technologies to modify the human germline has raised profound moral disagreement but also emphasizes the need for wide-ranging discussion and a well-informed policy response. The Hinxton Group brought together scientists, ethicists, policymakers, and journal editors for an international, interdisciplinary meeting on this subject. This consensus statement formulated by the group calls for support of genome editing research and the development of a scientific roadmap for safety and efficacy; recognizes the ethical challenges involved in clinical reproductive (...) applications of genome editing but, importantly, rejects the idea that human reproductive germline modification is necessarily morally unacceptable; and highlights the importance of meaningful engagement in discussions of genome editing and the development of regulation and oversight mechanisms to govern future uses of such technologies. Two groups of scientists have just announced what is being described as a leap forward in human stem cell research.1–3 Both have found ways of producing what are being called “induced pluripotent cells” , stem cells that they hope will demonstrate the same key properties of regeneration and unrestricted differentiation that human embryonic stem cells possess, but which are derived from skin cells not from embryos. In simple terms, these scientists have succeeded in reprogramming skin cells to behave like hESCs.Stem (...) cell research has been hailed as one of the most important and exciting areas of science, because it is believed that these types of cells will not only play an important part in regenerative medicine, but also yield valuable scientific information. These latest developments in cell reprogramming represent a milestone for stem cell science. No longer does the paradigm of irreversible cell specialisation hold true; instead, almost any type of cell might have the potential to become any other.The advent of techniques for producing these iPCs has also been hailed as an ethical breakthrough. Up until now, the production of hESCs has required a process which involves the destruction of embryos. Many of these embryos are available as by-products of IVF; but in addition, the process of somatic cell nuclear transfer to produce cloned embryonic stem cells requires a supply of human oocytes, which must currently be harvested from female donors at no insignificant cost. In a nutshell, iPCs seem to enable us to produce “embryo-free” human pluripotent stem cells, and in a “gender-neutral” way—that is, without the need for human oocytes.The response from the scientific community, ethical commentators and the public has, however, reflected an inherent confusion over the ethical significance of this research. Le dogme de flux de ľinformation génétique dans la cellule, DNARNA protéine est valable à la fois pour les procaryotes et les eucaryotes malgré des différences significatives au niveau de la structure et de la régulation des gènes. Contrairement aux génes procaryotes, la plu‐part des gènes eucaryotes sont morcelés. Le DNA codant pour une protéine est interrompu par des régions non‐codantes dont les transcrits sont éliminés par excision pendant la maturation du RNA messager ultérieurement traduit en protéine. How does a cell choose particular parts of its genetic information prior to transforming them into RNA and then into proteins? It will probably not be possible to give a coherent explanation of embryonic development, of cell differentiation, and of the maintenance of the differentiated state as until we have answered this question satisfactorily.In the first chapter, several basic notions concerning genetic expression are presented. The central dogma of the flow of genetic information in the cell, DNARNA‐ protein is valid both for prokaryotes and eukaryotes despite significant differences at the level of gene structure and regulation. In contrast to prokaryotic genes, most eukaryotic genes are split. The DNA coding for a protein is interrupted by non‐coding regions whose transcripts are eliminated by excision during the maturation of the messenger RNA which will subsequently be translated into protein. A wide variety of mecanisms are implicated in the regulation of these genes.The scope and limits of modern methods for the structural and functional analyses of genes are discussed in the second part of the article. Molecular hybridization, which is based on the complementarity between the bases of the nucleic acids, plays a key role in the study of the complexity and expression of genes. Recently, the application of recombinant DNA technology and associated techniques has allowed the isolation as well as the characterization of several eukaryotic genes. The question of the differential expression of these genes is currently studied intensively in many transcription systems which all have their strengths and weaknesses.As a conclusion, several implications of the prodigious progress of molecular genetics are discussed.ZusammenfassungDie Frage nach der selektiven Expression der genetischen Information in der Zelle ist fundamental. Das zentrale Dogma über den Fluss der genetischen Information in der Zelle, DNA RNA Protein, gilt sowohl für Prokaryonten als auch für Eukaryonten trotz bedeutender Unterschiede auf der Ebene der Genstruktur und Genregulation. Im Gegensatz zu den Genen von Prokaryonten sind die meisten Gene der Eukaryonten unterteilt. Die DNA, welche für ein Protein kodiert, ist durch nicht‐kodierende Regionen unterbrochen, welche wahrend des Reifungsprozesses der messenger RNA herausgeschnitten werden. Diese messenger RNA wird schliesslich in ein Protein iibersetzt. Sehr verschiedenartige Mechanismen sind an der Regulation dieser Gene beteiligt.Im zweiten Teil des Artikels werden Ziele und Grenzen moderner Methoden zur Analyse von Struktur und Funktion von Genen diskutiert. Molekulare Hybridisation, welche auf der Komplementarität zwischen den Basen der Nukleinsäuren beruht, spielt eine Schlüsselrolle in der Analyse der Komplexität und Expression der Gene. Die Anwendung der rekombinanten DNA Technologie sowie damit zusammenhängender Methoden hat kürzlich die Isolierung und Charak‐terisierung verschiedener eukaryontischer Gene erlaubt. Die Frage nach der differenziellen Expression dieser Gene wird gegenwärtig mit Hilfe verschiedener Transkriptionssysteme, welche alle ihre Stärken und Schwächen haben, intensiv studiert.Zusammenfassend werden verschiedene Implikationen des gewaltigen Fortschrittes der molekularen Genetik diskutiert. Elsewhere I have argued that particular degrees of imagination and consciousness, a cog­nitive process that I call reflective imagination, distinguish humans from other species and make possible, and underlie, the artistic experience. I take the artistic experience to be the universal and characteristically human capacity to experience oneself or others in a story by means of music, dance, song, pantomime, drawing, pretend play, or spoken or written language. In this paper I reconstruct the developmental path of the reflective imagina­tion via (...) the artistic experience in five stages: infancy, childhood, adolescence, adulthood, and senescence, and its plausible evolutionary trajectory from Australopithecines to Homo sapiens. Drawing upon both evolutionary and developmental theory, I conclude that the reflective imagination via the artistic experience has fulfilled, and still fulfills, important functions by activating memory systems, regulating emotional expression, promoting mutuality, training attentional focus, developing motor control, enabling prediction, free­ing from actuality, sourcing identity, complexifying consciousness, and affording behav­ioral adaptation.
